Agricultural occupancy condition

An occupancy condition on a residential property restricts the occupation of a property to an occupier who is or was last employed in agriculture/forestry or occasionally equestrian. The removal of the conditions can add significant value and improve the marketability of your property.

If the property has been occupied in breach of the condition for a continuous ten year period then there can be an opportunity to remove the condition through the application for a certificate of lawfulness.

There is also the opportunity to vary difficult conditions to better fit your circumstances.  We have had many successes removing or varying redundant occupancy conditions and consequently adding value to property.

We have also regularly worked with landowners to obtain planning consent for new agricultural workers dwellings in the rural area where development is not usually forthcoming, either through new build or change of use.
